Parliament approved another of a number of amendments to the Commercial Register Act, which concern the addition of identification data of statutory and legal entities in the Commercial Register. The amendment aims to reduce the administrative burden for entrepreneurs and the court's task is to automatically add identification data to the commercial register.

The Ministry of Justice, in cooperation with the registry courts, will perform an automated addition of identification data by 31. 05. 2022. If the legal entity does not receive notification from the court by this date about the completion of the given data, then the completion has not taken place.

For legal entities with foreign statutory bodies and partners, it is highly probable that the registry court will not perform the automatic completion of data.

A legal entity whose data could not be completed will be able to request the addition of data by submitting a change form to the Commercial Register. The change compared to the period before the amendment is that such a submission is not subject to a fee obligation. However, the submission must only relate to the missing identification data.

Every legal entity must fulfill the obligation to register the missing data by 30. 09. 2022, either with the help of a court or by its own filing. Otherwise, the statutory body faces a fine of up to 3,310,- EUR.

Please note that the registration court will no longer register any registration change for you unless the missing identification data is added.
